Theft / Robbery
The felonious taking of personal property in possession of another, from his or her person or immediate presence, and against his or her will, accomplished by means of force or fear. Essentially, it is theft coupled with an assault.
There are two categories of robbery in California, first and second degree. The primary distinction is made between ones committed in an inhabited dwelling, vehicle or ATM machine, and those committed elsewhere.
Attempted robbery requires a specific intent to commit a robbery and a cognitive, yet ineffectual, step taken towards its commission.
